If the parties cannot settle a dispute through negotiation within a period of 30 days, then the parties will attempt in good faith to resolve the dispute promptly by confidential mediation under the International Institute for Conflict Prevention & Resolution (“CPR”) Mediation Procedure currently in effect. The parties will conduct the mediation in Seattle, Washington. Each party will bear its own costs in mediation and the parties will share equally between them all third-party mediation costs unless the parties agree otherwise in writing. 20.4 Arbitration.. If the parties fail to settle all disputes within 30 days after the appointment of a mediator, the parties will settle any unresolved dispute arising out of these terms, the use of the services, or the Website by arbitration according to the International Institute for Conflict Prevention & Resolution Rules for Administered Arbitration currently in effect by a sole arbitrator. - In computing periods from a named date to a later named date, the words “from” and “commencing on” (and the like) mean “from and including,” and the words “to,” “until,” and “ending on” (and the like) mean “to but excluding.”
- References to a governmental or quasi-governmental agency, authority, or instrumentality will also refer to a regulatory body that succeeds to the functions of the agency, authority, or instrumentality.
- “A or B” means “A or B or both.” “A, B, or C” means “one or more of A, B, and C.” The same construction applies to longer strings.
- “Including” means “including, but not limited to.”
